Terms of Service and Public Offer
These Terms of Service constitute a public offer (public contract) from Valeriia Flowers (SRL «Valeriia Flowers»), a floristry studio and flower delivery service, addressed to any individual or entity (the «Buyer») wishing to purchase flowers, bouquets and gifts on the website valeriiaflowers.md. By placing an order, the Buyer confirms that they have read, understood and fully accepted these Terms. If you do not agree with any provision, please refrain from placing an order.
1. General Provisions
1.1. This document is a public offer within the meaning of the civil legislation of the Republic of Moldova. The Seller under this offer is SRL «Valeriia Flowers» (the «Seller», «we»), and the Buyer is any person who places an order (the «Buyer», «you»).
1.2. Placing an order on the website, by phone, or via WhatsApp/Viber is deemed full and unconditional acceptance of this offer and creates a binding contract between the Seller and the Buyer on the terms set out below.
1.3. The Seller reserves the right to amend these Terms at any time. The version published on the website at the moment an order is placed applies to that order.
1.4. The website operates 24/7. Order processing, confirmation and delivery are carried out during the Seller's working hours and subject to florist and courier availability.
2. Subject of the Offer
2.1. The Seller sells flowers, bouquets, floral arrangements and related gifts and arranges their delivery to the address specified by the Buyer, or provides them for pickup.
2.2. Product images on the website are illustrative. Because flowers are a natural and often hand-crafted product, the finished bouquet may differ slightly from the photograph in the shade of blooms, greenery or decorative elements, while preserving the overall composition, style and value of the order.
3. Placing an Order
3.1. An order may be placed through the website, by phone, or via WhatsApp/Viber at +373 79 43 49 55.
3.2. When placing an order the Buyer provides the information necessary for fulfilment: name and contact phone number, email (optional), delivery address, the recipient's name and phone number, the desired delivery date and time, and, where applicable, the text of the greeting card or message.
3.3. The Buyer is responsible for the accuracy and completeness of the data provided. The Seller is not liable for the consequences of an order being impossible to deliver due to incorrect or incomplete recipient details.
3.4. After an order is placed, the Seller may contact the Buyer to confirm the details, availability and delivery conditions. An order is considered accepted once confirmed by the Seller.
4. Prices and Payment
4.1. All prices on the website are stated in Moldovan lei (MDL). The price valid at the moment of order confirmation applies.
4.2. The following payment methods are available:
- Online bank card payment through the payment system PayNet;
- Cash to the courier upon delivery;
- Bank transfer.
4.3. Payment from abroad is accepted, which is convenient for customers of the Moldovan diaspora ordering flowers for delivery within Moldova.
4.4. When paying by card, the transaction is processed by PayNet. The Seller does not store and does not have access to your bank card details; the Seller retains only the payment status, the amount and the PayNet transaction identifiers.
5. Delivery and Pickup
5.1. Delivery in Chișinău is normally carried out within 1–2 hours of order confirmation (subject to workload and the chosen time slot).
5.2. Delivery within Chișinău is free for orders from 700 lei; for orders below this amount the delivery fee is 70 lei.
5.3. Delivery across Moldova is available according to the applicable tariff or by prior arrangement, depending on the destination.
5.4. Pickup is available at the studio in the Ciocana sector: bd. Mircea cel Bătrân 43B, Chișinău.
5.5. Before dispatch, we send the Buyer a photo of the finished bouquet for approval.
5.6. If the recipient is absent or cannot be reached at the specified time and address, the courier will attempt to contact the Buyer. Redelivery may require an additional arrangement and, where applicable, an additional fee.
6. Quality and Freshness Guarantee
6.1. We use fresh flowers and provide a freshness guarantee of 7 days from the moment of delivery, subject to normal care of the flowers by the recipient.
6.2. Before dispatch we send a photo of the assembled bouquet so that the Buyer can confirm it corresponds to the order.
6.3. If a bouquet arrives in unsatisfactory condition (wilted, damaged, or the wrong product delivered), please contact us as soon as possible, preferably on the day of receipt, and send us a photo. We will offer a replacement or a refund.
7. Returns and Cancellation
7.1. Flowers are a perishable and frequently custom-made product. For this reason, the 14-day right of withdrawal that applies to distance selling in the EU generally does not apply to them.
Important: the right of withdrawal does apply to non-floral goods. Soft toys, balloons, sweets in unopened factory packaging, vases and other accessories are neither perishable nor made to order. If you are in the European Union you may withdraw from such a purchase within 14 days of receiving it, without giving any reason. Simply tell us at [email protected] or on +373 79 43 49 55. The item goes back unused and in its original packaging; we refund what you paid via the original payment method. Return postage is the Buyer's unless we agree otherwise.
7.2. If the product is of inadequate quality, wrong, or damaged, please contact us promptly (preferably on the day of receipt) with a photo. We will propose a replacement or a refund.
7.3. Cancellation before assembly or dispatch of the order entitles the Buyer to a full refund.
7.4. Refunds are made to the original payment method (for card payments — through the PayNet system) within a reasonable time.

8. Rights and Obligations of the Parties
8.1. The Seller undertakes to:
- process the order and provide a product corresponding to the description and the confirmed order;
- send a photo of the finished bouquet before dispatch;
- deliver the order to the specified address or make it available for pickup within the agreed time;
- handle the Buyer's personal data in accordance with the Privacy Policy;
- respond to quality complaints and offer a replacement or refund where justified.
8.2. The Buyer undertakes to:
- provide accurate and complete order and recipient details;
- pay for the order using one of the available methods;
- ensure the possibility of receiving the order at the specified time and address;
- promptly report any quality issues, with supporting photos.
8.3. The Seller is entitled to:
- refuse or postpone an order if it cannot be fulfilled (e.g. unavailability of certain flowers, incorrect data, or force majeure), informing the Buyer;
- substitute individual components of a composition with items of equivalent value and quality while preserving its overall look and cost.
9. Liability and Its Limitations
9.1. The Seller is liable for the proper fulfilment of the order within the limits established by the legislation of the Republic of Moldova.
9.2. The Seller is not liable for failure or delay in delivery caused by the Buyer providing incorrect or incomplete data, the recipient being unavailable, or circumstances beyond the Seller's control.
9.3. The Seller is not liable for a natural variation in the appearance of a bouquet compared with its photograph, provided the composition, style and value are preserved.
9.4. To the extent permitted by law, the Seller is not liable for indirect or consequential losses. The Seller's liability in relation to an order is limited to the value of that order.
10. Intellectual Property
10.1. All content of the website — including texts, descriptions and photographs of products and compositions — is the property of the Seller or is used by the Seller with the appropriate rights, and is protected by law.
10.2. Copying, reproduction or any other use of the website's materials without the Seller's prior written consent is not permitted.
11. Personal Data
11.1. Personal data provided by the Buyer is processed for the purpose of placing, paying for and delivering the order, providing customer support, and complying with legal obligations, in accordance with Law of the Republic of Moldova No. 133 of 08.07.2011 on the protection of personal data (replaced from 23 August 2026 by Law No. 195 of 25 July 2024, which transposes EU Regulation 2016/679) and, for data subjects in the EU, Regulation (EU) 2016/679 (GDPR).

12. Force Majeure
12.1. The parties are released from liability for full or partial failure to perform their obligations if such failure results from force majeure circumstances that arose after acceptance of the offer and could not be foreseen or prevented — including natural disasters, extreme weather, fire, war, civil unrest, acts of public authorities, disruptions to transport, communications or supply of goods.
12.2. In the event of force majeure, the time for performing obligations is extended for the duration of such circumstances, and the parties agree on further steps, including the possibility of a refund where delivery becomes impossible.
13. Governing Law and Dispute Resolution
13.1. These Terms and any relations between the parties are governed by the law of the Republic of Moldova.
13.2. Disputes are resolved primarily through negotiation. If a settlement cannot be reached, the dispute is submitted to the competent court of the Republic of Moldova.
